On July 2, 2025, ICE published Directive 11064.4, entitled “Detention and Removal of Alien Parents and Legal Guardians of Minor Children,” which set forth policies and protocols regarding noncitizen parents and legal guardians in ICE custody. The Directive states that it is meant to ensure that parents impacted by ICE enforcement actions are able to make decisions about their children’s care. In the months since the Directive was issued, however, families and advocates have reported stories of individual parents, detained by ICE, who are not being given a chance to arrange for their children’s safe care. One estimate states that more than 145,000 children who are United States citizens have had their parent detained since January 2025, with more than a third of those children younger than six years old.
On February 2, 2026, The Young Center for Immigrant Children’s Rights (the Young Center) and the Center for Family Representation (CFR) requested that the government produce, pursuant to the Freedom of Information Act (FOIA), the records, data, and forms that ICE is required by the Directive to collect, monitor and maintain. The government denied the request and the administrative appeal of that denial.
On September 14, 2026, Terris, Pravlik & Millian, LLP and the Young Center, representing CFR, filed a lawsuit asking the United States District Court for the Southern District of New York to order ICE to produce the documents.
